ARTICLE 1 – SELLER’S IDENTITY

ETHNIK HORIZONS sells clothing, jewellery, accessories and gift cards, both in-store and online.
ARTICLE 2 – PURPOSE AND SCOPE
These Terms and Conditions of Sale define the rights and obligations of ETHNIK HORIZONS and its customers in connection with sales made through the website www.ethnik-horizons.com.
They apply to all orders placed by consumers acting for non-professional purposes.
The customer acknowledges having read these terms and conditions before confirming an order. Confirmation of the order constitutes unconditional acceptance of these terms and conditions.
The applicable terms and conditions are those in force on the date of the order.
ARTICLE 3 – PRODUCTS
The essential characteristics of each product are presented on its product page, including its description, material, colour, dimensions or size, price and availability.
The customer must consult this information before placing an order.
Product photographs are presented with the greatest possible care. Slight differences in colour may occur depending on the screen used or due to the handmade nature of certain products.
Slight variations in colour, weaving, patterns or finishes resulting from natural dyes or handmade production do not necessarily constitute a defect.
ARTICLE 4 – PRICES
Prices are stated in euros, inclusive of all applicable taxes and exclusive of delivery charges.
Delivery charges are shown to the customer before final confirmation of the order.
ETHNIK HORIZONS may change its prices at any time. The price charged will remain the price displayed when the order is confirmed, except in the event of an obvious display error.
Promotional offers are valid for the stated period and while stocks last.
ARTICLE 5 – ORDERS
The customer selects the desired products and adds them to the shopping basket.
Before confirming the order, the customer may review the selected products, quantities, prices and delivery method and correct any errors.
The order becomes final after:
confirmation of the shopping basket;
acceptance of these Terms and Conditions of Sale;
confirmation of payment.
An order confirmation is sent to the customer by email.
ETHNIK HORIZONS may refuse or cancel an order in the event of a declined payment, suspected fraud, incorrect information or stock unavailability discovered after the order has been placed. In the latter case, any amounts paid will be refunded.
ARTICLE 6 – PAYMENT
Payment is due when the order is placed.
Payment methods offered on the website may include:
bank card through the secure Stripe payment service;
PayPal;
any other payment method offered when the order is placed.
ETHNIK HORIZONS does not retain the customer’s full bank card details.
The order will only be prepared once payment has been successfully confirmed.
ARTICLE 7 – AVAILABILITY
Products are offered subject to stock availability.
If a product becomes unavailable after the order has been confirmed, the customer will be informed as soon as possible. Where possible, the customer may choose between an equivalent product, a credit note or a refund for the unavailable product.
No replacement product will be sent without the customer’s consent.
ARTICLE 8 – DELIVERY AND IN-STORE COLLECTION
Orders are shipped by Colissimo or any other carrier offered when the order is placed.
The customer may also choose in-store collection when this option is available.
The delivery areas, delivery charges and estimated delivery time for the selected method are shown before final confirmation of the order.
Unless a specific delivery period is stated, delivery will take place no later than thirty days after the contract is concluded.
The customer must check the accuracy of their name, address and contact details before confirming the order.
In the event of a significant delay, loss or damage to a parcel, the customer must contact ETHNIK HORIZONS at ethnik.horizons@outlook.com so that an investigation or claim can be submitted to the carrier.
ARTICLE 9 – TRANSFER OF RISK
ETHNIK HORIZONS remains responsible for the products until the customer, or a person designated by the customer, takes physical possession of them.
The customer is invited to inspect the condition of the parcel and products upon receipt and promptly report any issue, without this limiting the customer’s statutory rights.
ARTICLE 10 – RIGHT OF WITHDRAWAL
In accordance with the French Consumer Code, the customer has fourteen calendar days, starting on the day after receipt of the product, to exercise the right of withdrawal without having to provide a reason.
This right also applies to promotional, sale or clearance products, except where a statutory exception applies.
To exercise this right, the customer must inform ETHNIK HORIZONS before the end of the withdrawal period:
by using the withdrawal form available on the website;
or by sending a clear statement to ethnik.horizons@outlook.com.
Simply returning a product without giving prior notice is not sufficient to exercise the right of withdrawal.
ARTICLE 11 – RETURNING PRODUCTS
After informing ETHNIK HORIZONS of the decision to withdraw, the customer has fourteen calendar days to return the product to the following address:

The direct cost of returning the product is borne by the customer.
The customer must retain proof of dispatch and use a shipping method appropriate to the value of the product.
The product may only be handled to the extent necessary to establish its nature, characteristics, size and proper functioning.
A deduction may be made for any loss in value if the product has been worn or used beyond a simple fitting, washed, damaged, soiled, returned incomplete or returned in a condition that prevents it from being resold.
ARTICLE 12 – REFUNDS
In the event of a valid withdrawal, ETHNIK HORIZONS will refund the price of the product together with the standard delivery charges initially paid.
Any additional costs resulting from the customer’s choice of a delivery method more expensive than the standard method will not be refunded.
The refund will be made no later than fourteen days after the date on which ETHNIK HORIZONS was informed of the customer’s decision to withdraw.
ETHNIK HORIZONS may withhold the refund until the product has been recovered or until the customer provides proof that it has been dispatched.
The refund will be made using the same payment method used for the order, unless the customer expressly agrees otherwise.
ARTICLE 13 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the law, the right of withdrawal may not be exercised in particular for:
products made to the customer’s specifications or clearly personalised;
sealed products that are unsuitable for return for health protection or hygiene reasons when they have been unsealed after delivery;
gift cards that have already been used, in whole or in part, without prejudice to the right of withdrawal applicable to an unused gift card.
These exceptions are applied only when they genuinely correspond to the nature and condition of the product concerned.
ARTICLE 14 – STATUTORY WARRANTIES
All products sold are covered by the statutory guarantee of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code and by the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
In the event of a lack of conformity, the customer may request that the product be brought into conformity by repair or replacement, where this is possible and proportionate.
Failing this, the customer may obtain a price reduction or termination of the sale under the conditions provided by law.
The statutory guarantee of conformity may be exercised for two years from delivery of the product.
The warranty against hidden defects may be exercised within two years from discovery of the defect.
For any request, the customer may contact ETHNIK HORIZONS at ethnik.horizons@outlook.com, stating the order reference and providing a description of the issue and, where possible, photographs.
ARTICLE 15 – LIABILITY AND FORCE MAJEURE
ETHNIK HORIZONS may not be held liable for damage resulting from misuse of the product, failure to follow care instructions or use of the product for a purpose other than that for which it was intended.
ETHNIK HORIZONS may not be held liable in the event of an unforeseeable and unavoidable event meeting the statutory definition of force majeure.
Nothing in this article limits the consumer’s statutory rights.
ARTICLE 16 – PERSONAL DATA
Personal data collected when an order is placed is used to process purchases, arrange delivery, manage customer relations, prevent fraud and comply with accounting and statutory obligations.
Detailed information about the processing of personal data and the customer’s rights is provided in the website’s Privacy Policy.

ARTICLE 17 – CONSUMER MEDIATION
After submitting a written complaint to ETHNIK HORIZONS, and if no satisfactory amicable solution is reached, the consumer may use a consumer mediator free of charge.
ARTICLE 18 – INTELLECTUAL PROPERTY
The photographs, texts, logos, illustrations, graphic elements and content available on www.ethnik-horizons.com are protected by intellectual property laws.
Any reproduction or use without prior authorisation is prohibited, except where permitted by law.
ARTICLE 19 – GOVERNING LAW AND DISPUTES
These Terms and Conditions of Sale are governed by French law.
In the event of a difficulty, the customer is invited to contact ETHNIK HORIZONS first in order to seek an amicable solution.
If no amicable agreement or mediation is reached, the dispute may be brought before the competent court in accordance with the statutory rules applicable to consumers.
If any provision of these terms and conditions is declared invalid, the remaining provisions will continue to apply.
